The more I think about this (and I am probably showing my ignorance here) but why are Federal judges deciding State matters?
And, it's a federal matter because of the DOE funding. Gotcha. That makes sense. But, I have a simple solution. Get rid of the DOE.It's not ignorance, it's just complicated.
There are a few instances federal judges could have jurisdiction, one of which is if there's a constitutional question.
So for example a state could pass a law saying that residents of the state no longer have freedom of speech. Federal courts would overturn that.
Of course. That is how you get paid off.
