I believe you are noticing the difference between offensive and defensive 12 men.

The offense cannot have 12 men in the huddle. As soon as they do that, it's a penalty and a dead ball. No play.

The defense CAN have 12 men on the field up until the snap, so that they can make substitutions. So it's not a penalty until the snap, and at that point if there are still 12 or more defensive players the offense has the option of taking the result of the play or the penalty.

This rule was changed after the second Giants patriots super bowl. Refs should whistle the play pre-snap if the defense has 12 and the "snap is imminent". The play should never be allowed to happen.

Only thing I can think of is the NFL revised that rule afterwards so it's only effective, for example, in the final 2 min of a half.
