I don't think it changes anything if this was a failed drug test due to the marijuana still being in his system.

I have seen people get charged with DUI because when the police haul them into the hospital for a blood test, the blood comes back as something low like .05, which is under the limit, but the blood also turns up THC, and so they get charged with DUI. Problem is, the THC could have been from a month ago. No one is still high a month after smoking, but since the police can't tell when it was smoked, they just charge the guy anyway.

It's bullshit, but all the cop has to do on the stand is say "He was swerving and then when I pulled him over he had marijuana in his system." In a county of backwoods idiots, they'll convict out of drug paranoia. You are better off pleading guilty to a lesser charge even if you were under the legal alcohol limit and were not high at all, because they want to screw you over. It's not worth it to take the risk you get a couple of intelligent jurors who will reject the state's propaganda.

Obviously Josh Brent is in a different situation than the one I am describing but my point is, the judicial system needs to come to the realization that failing a marijuana test means very little. Its not a good indicator at all of when or how it was consumed because it stays in the system for so long. It's very unreliable and only shows that it was, at some point, consumed.

So I am not automatically up in arms when I hear that he failed a second marijuana test a week after the first. If you want to release him because he clearly smoked marijuana after being arrested like 8 months ago, fine, then make that your reasoning. But don't tell me it's because he failed a 2nd test.

Probably boils down to "I'm not gonna let that darn media tell me what to do!"

The whole thing makes a mockery of the RKG movement, which was silly to begin with.

There never was a "RKG" thing.

That is a fan construct to make themselves feel better about Jason Garrett.

It helps to pretend he's got stroke, unlike Fat Wade.

Dallas Cowboys defensive lineman Josh Brent failed a second drug test and was sent back to jail on Thursday, according to the Dallas County District Attorney's office. Despite Brent's return to jail, the Cowboys have no immediate plans to part ways with him, league sources told ESPN's Ed Werder.

A Dallas County judge held Brent's bond "insufficient," the DA said. The DA had filed a motion on Tuesday asking a judge to revoke Brent's bond because it was revealed he failed a drug test taken on June 19.

Brent was out on bail after being charged with intoxication manslaughter resulting in the death last year of best friend and teammate, Jerry Brown.

Brent is still on the Cowboys' 90-man roster.

Cowboys executive vice president Stephen Jones said the team would have no comment and Brent's agent, Peter Schaffer, said he's aware of everything involving the case, but wouldn't comment further.

According to court records, Brent has tested positive for marijuana twice.

Brent had a bond hearing scheduled for July 19 when the Dallas DA said he failed a drug test in late May. Brent has his trial for the intoxication manslaughter charge scheduled for Sept. 23.

Brent's attorneys have held preliminary discussions about a plea deal. Brent is subject to the NFL's personal conduct policy, which could lead him to a suspension or fine. League officials were awaiting for Brent's legal situation to be completed before rendering a decision on his future.

I honestly think they are hanging onto this turd with the intent of him playing again somehow.

There is no other logical explanation.

while it's a reasonable position to release Brent I don't think he should be on parity with the conduct of Hernandez. His original charge while abhorrent wasn't a premeditated act. The man is excessively gifted with stupid.
 
Brent = George trying to get fired but just can't pull it off

I guarantee he'd still be a Cowboy. They wouldn't release him until he was tried and convicted.
