It's not even close to being the same. There is no physical presence in scenario 1. The idea that these two thoughts are congruent is an unreasonable stretch.I think it is a legit question. You are fine being recorded, you are fine with your conversations being archived, you are fine with any government official listening and going through those records for any reason he wants...
