Collusion is a term of art. The legal basis for any illegal activity vis-a-vis the Trump campaign and Russia is criminal conspiracy. He did not find sufficient evidence to bring charges against him.
Do you know what the fuck that even means? Prosecutors bring charges all the time when they don’t have “proof” but they think they have enough information to persuade a jury that it likely happened. In this instance, Mueller is saying “we don’t even have enough information to bring charges, let alone conviction ‘beyond a reasonable doubt.’”
That’s legalese for exonerated on “criminal conspiracy,” - or, as the media kept calling it, collusion.
That’s what it fucking means.
If you don’t find even enough evidence to charge, then he’s exonerated.
you know what he did find evidence of? Obstruction of justice.
Evidence of obstruction of Justice isn’t evidence of Russiagate “collusion,” or, as I said, criminal conspiracy. So he was exonerated on the collusion.
The obstruction part is in reference to the administration wasn’t cooperating with the investigation. And prosecutors are used to being able to bark demands at the parties they are investigating and having them comply.
The problem is that Mueller was investigating his boss. The whole concept of obstruction means that you are doing something illegally to hinder an investigation.
But Trump has complete authority over said investigation. He could have legally issued an order demanding that Mueller cease the investigation. It would have pissed off Congress something fierce, the Democrats would have called for impeachment, but there’s not a damn thing anyone could do about it.
And Mueller also admitted this point in the report because he acknowledged it is not an accepted theory of law universally that the President couldn’t demand a halt to the investigation.
Trump behaved during the investigation under that theory. He knowingly did stuff that would have gotten other people charged with obstruction BECAUSE LEGALLY HE KNEW (and was advised by his attorneys) that it was a legal impossibility for him to obstruct justice. He could have told Mueller to shred all the evidence and it would have been completely legal.
But he didn’t. He allowed the investigation to reach its conclusion, because he was not guilty. And all the bellyaching about obstruction is completely and utterly irrelevant.
The Supreme Court later even issued an opinion proving I’m right - they said a President cannot be charged for actions relating to his official capacity, one of which is administering the DOJ.
Ex post facto, the Mueller report is completely worthless about anything it said on obstruction: the Supreme Court has weighed in, a President cannot obstruct his own justice department.
So you are wrong. Because you are ignorant.
