I believe you are noticing the difference between offensive and defensive 12 men.Agreed. Which is why I'm confused when I've seen refs allow the offense to run the play and even decline the penalty to take the result of the finished play.
The offense cannot have 12 men in the huddle. As soon as they do that, it's a penalty and a dead ball. No play.
The defense CAN have 12 men on the field up until the snap, so that they can make substitutions. So it's not a penalty until the snap, and at that point if there are still 12 or more defensive players the offense has the option of taking the result of the play or the penalty.
