Marion Barber III -- former Dallas Cowboys running back -- was arrested in Texas yesterday ... TMZ Sports has confirmed.

According to police records, Barber was arrested just after 8PM on Sunday night -- and he's being held for "mental detention and observation."
Police tell TMZ Sports Barber was taken into custody at his home. However, sources tell us the incident for which Barber was arrested occurred at a nearby church.

So far, it's unclear exactly why Barber was arrested. We're workin' on it.

31-year-old Barber played in the league from 2005 to 2011 -- all but one year with the Cowboys. He spent his final season with the Chicago Bears ... and retired in 2012.

If he's under observation for mental health, he wasn't arrested.

In Texas they have something called Arrest by a Peace Officer Without a Warrant and lets the police basically put a psych hold on people to keep them from hurting themselves. No criminal charges are filed but they can force you to go for psych eval and hold you. Hopefully it's something like that, and not some combination of psych problems + criminal activity.

Police in Mansfield, Texas detained former Cowboys running back Marion Barber on Sunday night and then took him to a hospital for mental observation after responding to a disturbance call.

A police department spokesman said Monday, via the Fort Worth Star-Telegram, that Barber was taken to a local hospital after officers responding to the call determined it was the best course of action. He also said that Barber was not arrested, although the newspaper reports that a police log shows Barber was “arrested on an application for mental detention and observation.” The spokesman said he did not know whether Barber was still in the hospital.

TMZ initially reported Barber’s trip to the hospital and add that the inciting incident for the entire turn of events took place outside a church before police went to Barber’s home.

Barber began his career with the Cowboys as a fourth-round pick in 2005 and played for Dallas through 2010. He last played for the Bears in 2011.

Not necessarily true. They can do both here in Missouri.
I find that hard to believe. A legal hold for mental health observation is not the same as an arrest. It doesn't go on your record. It's called a Baker Act in Florida.

Yes, that's what I'm assuming it is and there is no arrest or charges. The Baker Act in Florida is up to a 72 hour hold and that's the typical length of time.

You can be under arrest for a crime but if you display suicidal issues or mental problems they will also send them for a mental evaluation.

Of course, but they are separate issues. You aren't arrested for a crime when placed under observation on it's own. Plus in most places, jails have suicide precautions set up so if they have someone they feel needs the observation, they do it internally instead of transporting them to another facility.

Sounds like they "APOWW-ed" him. Sounds like no criminal charges, just a pysch hold. Hope he gets some help.
